O termo genérico “pirataria” envolve um leque imenso de atividades. A repressão paliativa de suas manifestações isoladas dissimula a força e a abrangência do fenômeno. Mas é absurdo assemelhar o comércio ilegal de bens culturais ao de quaisquer outros produtos gerados por contrabando ou falsificação. Reproduzindo as engrenagens do tráfico, chega-se ao cúmulo de criminalizar a busca por informação, marginalizando seu “usuário. E, também nesse caso, criando instrumentos segregacionistas: a defesa do copyright equivale à tentativa de preservar desigualdades.

Mas todas as classes sociais se locupletam cotidianamente da informalidade, sob tolerância generalizada. Comércio, indústria e residências estão repletos de computadores e outros equipamentos irregulares. Jogos, músicas e filmes clandestinos entretêm milhões de famílias por todo o país, sem contar o furto de sinais da TV a cabo. A cópia integral de livros impede o colapso do ensino universitário, em especial nas instituições públicas, cujas bibliotecas possuem acervos ridículos.

O camelô virou bode expiatório do farisaísmo pequeno-burguês. Os preços irrisórios cobrados pela pirataria não justificam os custos exorbitantes do mercado regular, antes iluminam sua face gananciosa e excludente. Produtos culturais de grande circulação independem do varejo, pois se viabilizam previamente com publicidade, renúncia fiscal e eventos associados. Autores recebem migalhas, enquanto os lucros enriquecem uma rede de intermediários ociosos e insensíveis à produção artística.

A hipocrisia legalista faz parte de uma estratégia para impedir a disseminação da cultura regular, oficial, legítima. O exclusivismo cria nichos, eleva preços, alimenta ilusões de superioridade.
